Maître Lucas MONTAGNIER (Lucas MONTAGNIER, Esq.) assists and represents individuals arrested as part of the execution of a European or international arrest warrant.

A European arrest warrant is set out by the French Code of Criminal Procedure as “A judicial decision issued by a Member State of the European Union called issuing Member State for the arrest and surrender of a wanted person by another Member State called executing Member State, for the purposes of criminal prosecutions or the execution of a custodial sentence or measure.

When the wanted person has been arrested, he or she must be brought before the General Prosecutor within 48 hours.

The arrested person’s rights must mandatorily be notified to him or her. In particular, the General Prosecutor must inform such person that he or she can either consent or object to his or her surrender to the judicial authority which issued the European arrest warrant.

The regime applicable to the execution of the European arrest warrant will vary depending on that choice

  • In case of consent, an alleviated procedure is applied: the Investigating Chamber (chambre de l’instruction) adjudicates no later than seven days after the person’s appearance before such Chamber and no further appeal is possible.

  • In case of refusal, the Investigating Chamber can make its decision up to twenty days after the person’s appearance and such decision can be appealed against by the General Prosecutor or the wanted person if he or she does not consent to his or her surrender.

Upon completion of the person’s appearance before the General Prosecutor, a decision is made as for such person’s possible imprisonment or probation.

If the General Prosecutor deems that imprisonment is necessary, he or she has the person brought before the Senior President of the Court of Appeal. If such magistrate considers that the person’s representation during all the steps of the proceedings is not guaranteed, he or she orders that such person be placed in extradition custody in the prison of the Court of Appeal in the area of jurisdiction of which the person was arrested.

Nevertheless, the person placed in extradition custody can submit requests for release “at any time”.

It should be recalled that the European arrest warrant is applicable:

  1. Either when it is issued for the purpose of prosecutions for criminal offences punished with a custodial sentence of at least one year;

  1. Or when it is aimed at enforcing a pronounced prison sentence of at least four months.

The two conditions are obviously not cumulative.

If these conditions are not fulfilled, the lawyer must make all efforts to hinder the execution of the warrant.
